Renting in Pattaya: deposits, contracts and TM30

Most long-term rentals in Thailand run on a one-year lease, with a deposit of one or two months' rent plus the first month in advance. Landlords who rent out three or more homes must follow national rules from September 2025 on deposits, refunds and bills, and every landlord must report a foreign tenant to immigration on form TM30. Tenants pay 09Wi no fee.

What you pay up front

In Bangkok, where most published figures come from, the usual condo rental is a one-year lease with a security deposit of one to two months' rent, two being most common, plus one month's rent in advance. That means about three months' rent at signing. No Pattaya-wide figures are published, so ask each owner.

The two condos we list in Central Pattaya show how terms differ from unit to unit. On 1 November 2026, a studio at The Trust Condo Central Pattaya was listed at THB 8,500 a month on a one-year lease or THB 12,000 a month on a monthly contract, and a one-bedroom at City Center Residence at THB 15,000 a month on a one-year lease with two months' rent as deposit. The monthly contract on the studio costs about 40% more a month, which is the price of being able to leave sooner.

Where the 2025 rules apply, the deposit and advance rent together may not exceed three months' rent on a short-term lease or a long-term lease paid monthly, or one year's rent on a long-term lease paid annually. So two months' deposit plus one month in advance is the most a covered landlord may take on a normal monthly lease.

09Wi charges tenants nothing. We are paid by commission from the owner, so the deposit and rent go to the owner as set out in your contract.

The 2025 residential lease rules

The Contract Committee of the Office of the Consumer Protection Board made residential leasing a contract-controlled business in a notification of B.E. 2568 (2025). It was published in the Government Gazette on 6 June 2025 and took effect on 4 September 2025 (one law firm gives 5 September). Key points:

  • It covers any landlord renting out at least three residential units, including leases made through online platforms. The 2019 rules it replaced covered landlords with five or more.
  • Hotels and dormitories are outside it.
  • Contracts made under the 2019 rules stay valid until they expire.
  • Short-term means up to 3 years; long-term means over 3 years and up to 30 years, or the tenant's lifetime.
  • Breaches can bring up to 1 year in prison, a fine of up to THB 200,000, or both.

An owner renting out a single condo is not covered. Even so, the rules make a fair benchmark when you negotiate with any landlord, and older articles quoting a one-month deposit cap from the 2018 rules are out of date.

Getting your deposit back

Under the 2025 rules a covered landlord must return the deposit as soon as the lease ends. If an inspection is needed, the deadline is 7 days when there is no damage, or 14 days when there is damage, after the repair costs are deducted. Nothing may be deducted for normal wear and tear. Keeping a deposit when the tenant is not at fault, charging a renewal fee and locking a tenant out are all prohibited.

Whoever your landlord is, protect yourself at check-in: walk through the unit with the owner or agent, photograph every room and appliance, note existing marks in the inventory, and keep the signed copy. At check-out, do the same walk-through and settle the last bills before you hand back the keys.

What to check in the contract

  • Names, passport numbers, the unit number and the building.
  • The term, the monthly rent, the deposit and advance amounts, and the date rent is due.
  • What the rent includes: furniture, appliances, the building's common fee, internet, cleaning.
  • How electricity and water are billed. Covered landlords may not charge above the official tariffs and must send invoices at least 3 days before the due date.
  • Early exit. Under the 2025 rules a tenant on a fixed term may leave early after living there for at least half the term, with 30 days' notice and all payments cleared.
  • Renewal: how the next term and rent are agreed.
  • Who files TM30, and the building's house rules on pets, guests and parking.

A lease of more than 3 years must be in writing and registered at the Land Office, or it can only be enforced for 3 years. Registration costs 1% of the total rent for the term plus 0.1% stamp duty, and landlords usually ask the tenant to pay it.

TM30: reporting where you stay

Under Section 38 of the Immigration Act, the house master, owner or possessor of the place where a foreigner stays must notify immigration within 24 hours on form TM30. Where there is no immigration office, the local police station is notified. For a rented condo or house, that duty falls on the landlord, and the fine is up to THB 2,000 (THB 2,000 to 10,000 for hotel managers).

After a 2020 change, the landlord does not need to file again each time the same foreigner returns to the same place within the period already reported. Filing can be done in person, by post, or online through immigration.go.th or the Section38 app. In July 2026 immigration reminded landlords that the 24-hour rule applies in Pattaya and Chonburi. Ask your landlord for a copy of the TM30 receipt and keep it with your passport papers.

Daily and weekly stays

Commentators read the Hotel Act as treating paid stays of under 30 days as hotel operation, which needs a hotel licence. Many condominium buildings also ban short-term letting in their rules, and the Interior Ministry ordered inspections of condos rented to tourists in February 2025. For a stay in a condo, plan on a lease of 30 days or more.

Choosing where to rent

Jomtien is mostly condominiums along a long beach, with many long-stay and retired residents. Pratumnak sits on the hill between Pattaya Beach and Jomtien, with high-rise towers, lower-density blocks and villas. Central Pattaya is the densest area, close to the malls and the beach. Naklua and Wongamat in the north have quieter beaches. East Pattaya, inland of Sukhumvit Road, is where most houses and pool villas are.

Na Jomtien, further south in Sattahip District, has poorer public transport links to Pattaya, which matters if you will not drive. For a tighter budget, look at monthly rooms for rent; for space and a garden, houses for rent.

Questions tenants ask

How much deposit is normal when renting in Pattaya?

Usually one or two months' rent as a security deposit plus one month in advance, so about three months' rent at signing on a one-year lease; that is the usual Bangkok pattern, and Pattaya owners set their own. Landlords with three or more units may not take more than three months' rent in total on a monthly-paid lease.

Can my landlord keep my deposit?

Only for real damage or unpaid bills. A landlord covered by the 2025 rules must return the deposit when the lease ends, within 7 days if there is no damage or 14 days if there is, and may not deduct for normal wear and tear.

Do tenants pay 09Wi a fee?

No. Tenants pay 09Wi nothing; we are paid by commission from the owner. Browse condos for rent or message us with what you need.

Who files the TM30 when I rent a condo?

The landlord, as owner or possessor of the residence, must report you to immigration within 24 hours of your arrival. It can be filed online through immigration.go.th or the Section38 app. Ask for a copy of the receipt.

Can I leave a one-year lease early?

Check your contract first. If your landlord is covered by the 2025 rules, you may leave after living there for at least half the term, with 30 days' notice and all payments cleared, and keep your deposit subject to damage.

Can I rent a condo in Pattaya by the month?

Often yes, at a higher monthly rent than on a one-year lease. Stays of 30 days or more keep the rental outside the Hotel Act. Monthly rooms in apartment buildings are another option; see rooms for rent.

Do the 2025 lease rules apply to every landlord?

No. They cover landlords renting out three or more residential units, including through online platforms. A private owner letting a single condo is not covered, though the rules are a useful standard to ask for.

Do I need to register my lease?

Only if it is longer than 3 years. A longer lease must be in writing and registered at the Land Office to be enforceable beyond 3 years, at 1% of the total rent plus 0.1% stamp duty.
