What legal structures can a foreign house buyer use?

The Land Code bars foreigners from owning land in their own name. The house can be treated separately. The usual structure is a registered lease of the land for up to 30 years, with the house held under a registered superficies, which is the right to own a building on someone else's land. A usufruct, the right to use and benefit from the land, is another registrable option. Each is registered at the Land Office.

Be careful with promises of automatic renewals. In 2023 the Supreme Court held a prepaid "30 plus 30 plus 30" lease arrangement void because it got around the 30-year limit. Holding land through a Thai nominee or a sham Thai company is illegal, and since May 2026 the Department of Lands checks buyers' funds and companies with foreign shareholders more closely.

Which title deed does the house sit on?

Ask which deed the house sits on before anything else. A chanote is full ownership, with boundaries fixed by ground survey. Nor Sor 3 Gor is a right of use with boundaries from aerial photographs and can usually be upgraded to a chanote. Nor Sor 3 has no survey and needs a 30-day public notice before a sale is registered. Sor Kor 1 is only a notice of possession and cannot be used for an ordinary transfer. Read our title deed guide before you make an offer.

Where should you look for a house in Pattaya?

Most houses for sale are inland in East Pattaya, east of Sukhumvit Road, where plots are larger and streets are greener. Jomtien has also seen new housing projects next to its condo towers, closer to the beach.

Questions people ask

Do I pay 09Wi a fee?

No. Tenants and buyers pay 09Wi nothing. The seller pays our commission.

Can a foreigner own a house in Pattaya?

A foreigner can own the house, held under a registered superficies, but not the land in their own name. The land is usually leased for up to 30 years and registered at the Land Office.

Which title deed should I look for?

A chanote gives full ownership and is the safest. Nor Sor 3 Gor is acceptable to many buyers and can usually be upgraded. Be cautious with Nor Sor 3, and avoid Sor Kor 1 for a purchase.

What costs come on top of the price?

A 2% transfer fee on the appraised value, withholding tax, and either 3.3% specific business tax or 0.5% stamp duty, split as the contract says. A registered lease costs about 1.1% of the total rent. See our guide to taxes and transfer fees.

Can I buy through a Thai company?

Only if the company is real and Thai-controlled under the law. Using a company or a Thai person as a front for a foreign buyer is illegal, and the Department of Lands now screens companies with foreign shareholders closely. Get independent legal advice first.
